TERMS OF SERVICE
ZEUST LIMITED, a legal entity organised and existing under the laws of Cyprus Republic, with the address: 1 Avlonos Street, Maria House, 1075 Nicosia, Certificate of Incorporation number HE362856 (hereinafter called as the “FANYTEL”).
2.1. The “Application” shall mean the software provided by Fanytel for the purpose of offering services related to mobile calling services, to be used on Android OS devices and Apple iOS, periodic upgrades along with any other software or documentation which enables the use of the Application.
2.2. Fanytel is a service that allows users to make and receive calls while overseas.

4. PROPRIETARY RIGHTS AND LICENCE
4.1. All trademarks, database rights, copyright and other intellectual property rights of any kind in the Application together with the original software code is owned directly by Fanytel.
4.2. Fanytel hereby grants you global, royalty-free, revocable license to use the Application for your personal or business use in agreement with these app terms.
5. CONDITIONS OF USE
5.1. You will not resort to and neither allow any third party on your behalf to (i) make and subsequently distribute copies of the Application (ii) attempt to copy, reproduce, alter, reverse engineer, modify, transfer or exchange the Application; or (iii) create imitative works of the Application of any kind at all.
5.2. The rates for the Fanytel services are available on the application. Fanytel reserves the right to change the rates at any time without giving any prior notice. In case you do not wish to accept such adjustment of rates then you are entitled to close the account with effect from the date on which the adjustment of rates would become effective. You confirm that by continuing to use the Fanytel services, following the amendment of the rates, you accept such adjustments.
5.3. You accept the terms of agreement with your respective mobile network provider who will continue to apply when you use the Application. Subsequently, you might be charged by the mobile provider for use of network connection services for the period of the connection while using the Application or any such third party charges which might arise. You admit responsibility for any such charges that may come to pass.
5.4. If you are not the payer of the bill for the handheld device or mobile telephone being utilised to access the Application, you will be understood to have received consent from the bill payer for using the Application.
5.5. In case your device gets stolen or if you realise unauthorized use of the Fanytel services you must at once alert us immediately to suspend the Fanytel services. You are solely liable for all charges to your account with Fanytel (“Account”) until the Fanytel Services are stopped.
5.6. In order to buy credits for the Fanytel service and to charge your Account, you shall pay Fanytel the rates as stated on the website or on the application. Payments are made by you, unless stated otherwise.
5.7. All rates and charges shall be stated in USD.
5.8. Fanytel services are for individual use only. Using the services for telemarketing or call centre operations, re-selling the subscription minutes, calling numbers (whether singly, sequentially or automatically) to generate income for yourself or others as a result of placing the call, will not be considered legitimate.
5.9. You will not resort to unusual calling patterns inconsistent with normal, individual subscription use, for example, regular calls of short duration or calls to multiple numbers in a short period of time.
6. EMERGENCY CALLS
6.1. The Fanytel service is not aimed at supporting or making emergency calls to any type of law enforcement agencies, hospitals, medical care unit or emergency services of any kind and Fanytel is not liable in any manner for such calls. In case another user uses your Account, with your permission, then you are responsible to inform the user that it is not possible to make any emergency calls with Fanytel service.
This Application is accessible in handheld mobile devices which run on Apple iOS or Android OS operating systems. Fanytel will utilise all rational efforts to make the Application accessible at all times. However, please accept that the Application is provided over the internet & mobile networks, hence, the quality and availability of the Application is determined by factors outside Fanytel’s reasonable control.
8. SYSTEM REQUIREMENTS
8.1. In order to utilise the Application, a compatible handheld device, access to internet and the necessary minimum specifications (‘Software Requirements’) are required.
8.2. The Software Requirements include: Apple iOS devices, Android OS devices.
8.3. The version of the Application software may be periodically upgraded to add support for new functions and services.
9.1. Fanytel may terminate use of the Application at any time by providing notice of termination.
9.2. Upon termination at any time, (a) all the rights and license granted to you herein shall end; (b) you must stop all use of the Software.
10. LIMITATION OF LIABILITY
10.1. Under no circumstance, will Fanytel be accountable for any direct, indirect, special, punitive, exemplary or consequential losses or damages of whichever kind occurring out of your usage or access to the Application, including loss of profit or similar, whether or not in the contemplation of the parties, whether based on breach of contract, product liability or otherwise.
10.2. Fanytel is not accountable to you for any damage or change to your equipment including but not limited to computer equipment, handheld device, owing to the installation or use of the Application.
10.3. Nothing in these App terms shall exclude or limit Fanytel’s legal responsibility/accountability for death or personal injury caused by neglect or for deception or fraudulent misrepresentation or any other liability which cannot be excluded or limited under applicable law.
10.4. If you are living in a jurisdiction where it is forbidden by law to offer or use internet telephony or the Fanytel services, you may not accept this Agreement.
11. DISCLAIMER OF WARRANTIES
11.1. Fanytel does not make any express guarantee/warranty regarding the Fanytel services and disclaim any implied warranty, including any warranty of merchantability, satisfactory quality, or fitness for a particular purpose; however Fanytel shall make efforts to provide its services with least disruptions. However, Fanytel cannot guarantee that the Fanytel Services will always function without interruption, impediment or other limitations.
12.1. Fanytel reserves the right to verify the credentials of a user who has made a payment either through credit/debit card or CashU with the sole aim to avoid any fraud payments. The required documents for the verification of the afore-mentioned purpose includes identity documents like Driving License issued by home country/Passport/Social Security Card/National Identity Document or any such relevant document applicable in the country in which the document was issued. Fanytel takes complete authority of cancelling the transfer of credit in the Fanytel account of the user who does not submit any one out of the documents mentioned above.
12.2 Fanytel also reserves the right to demand a signed copy of the credit/debit card to be sent by email/Whatsapp, for the purpose of verification of the authenticity of the payer. Fanytel does not store any card details and customers will be encouraged to blank out CVV details/ Security code to protect the card being misused. Fanytel will hold no responsibility and is neither liable to pay for any complaint received by the card holder for any fraud transaction.
13. FAIR USAGE POLICY
All our ‘Calling Packages’ are subject to the Fair usage policy as described below. The packages have been designed for individual usage where users use the same to call their friends and family. Usage restrictions like number of unique phone numbers that can be called may be mentioned along with the package details. Even if they are not mentioned, the maximum unique numbers that a package user can call in the billing period will be limited to 5 phone numbers. This is done to ensure that usage is limited to personal reasons and not used for any commercial/tele-calling/services calling operations, where calling facility is given to multiple people by one package user.
Outcall packages are only meant for individual usage and are not for use in commercial or semi – commercial purposes. All users who purchase the outcall packages are found by a fair usage policy guidelines, which can be revised from time to time.
14. REFUND POLICY
Payment once made will not be refunded, so please check carefully before making the payment.
If a call duration exceeds by 60 seconds, then it will be charged for 2 minutes. For example, if you make a call that lasts for 1 minute 1 second, then the call is rounded to 2 minutes.
Fanytel Credit Card payments will appear as ZEUST LTD on your bank or card statement.

Information we collect about you.
When you use our Services, we may collect the following information, including without limitation:

Fanytel collects, uses and stores your Personal Data in accordance with applicable Cyprus Law and EU directives regarding the Protection of Persons and Personal Data, as modified.
Fanytel uses your Personal Data for the provision of Services and billing purposes.
Fanytel may use your Personal Data to improve their Services.
Fanytel may use your Personal Data to defect misuse of its system and / or a customer account.
Fanytel may use the Personal Data to provide you with information relating to your account.
Fanytel may use the Personal Data for marketing purposes, unless you object to this. Thus, you may at any time and without charge, contact Fanytel to stop any use of your Personal Data for advertising or solicitation purposes.
Fanytel and any partner involved in providing the Services will store your Personal Data no longer than the time necessary to provide Services and, in any case, no longer than the maximum period permitted by the local laws, rules and regulations on Personal Data protection.
Disclosure and sharing of your Personal Data
Fanytel ensures the confidentiality of your Personal Data and will never disclose them to third parties without your consent, apart from the partners involved in providing the Services.
However, these partners involved in providing the Services will only receive the Personal Data required to perform Services. Fanytel and its partners are prohibited from using your Personal Data for any other purposes.
Your Personal Data can be transmitted and stored in the European Union, offering an adequate level of protection.
By using the Services provided by Fanytel, you agree that your Personal Data can be transmitted to partners in Members States of European Union or in countries providing adequate protection for the provision of the Services.
Personal Data may additionally be communicated to any employee of Fanytel or any partner involved in providing the Services. The communication to these third parties is limited to data necessary for the performance of their tasks for the same purposes as the one of Fanytel.
Access to your Personal Data
You can request free access to your Personal Data processed and stored by Fanytel in the secure MyAccount section.
You have the following rights:
Right of access to your Personal Data: You have the right to ask us for confirmation on whether we are processing your Personal Data, and access to the Personal Data and related information on that processing (e.g., the purposes of the processing, or the categories of Personal Data involved).
Right to correction: You have the right to have your Personal Data corrected, as permitted by law.
Right to erasure: You have the right to ask us to delete your Personal Data, as permitted by law. This right may be exercised among other things: (i) when your Personal Data is no longer necessary for the purposes for which it was collected or otherwise processed; (ii) when you withdraw consent on which processing is based and where there is no other legal ground for processing; (iii) when you object to processing pursuant to Art. 21 (1) GDPR and there are no overriding legitimate grounds for the processing, or when you object to the processing pursuant to Art. 21 (2) GDPR; or, (iv) when your Personal Data has been unlawfully processed.

Right to data portability: You have the right to receive the Personal Data that you have provided to us, in a structured, commonly used and machine-readable format, and you have the right to transmit that information to another controller, including to have it transmitted directly, where technically feasible.
Right to object: You have the right to object to our processing of your Personal Data, as permitted by law. This right is limited to processing based on Art. 6 (1) (e) or (f) GDPR, and includes profiling based on those provisions, and processing for direct marketing purposes. After which, we will no longer process your Personal Data unless we can demonstrate compelling legitimate grounds for the processing that override your interests, rights and freedoms or for the establishment, exercise or defense of legal claims.,
We will retain your Personal Data for as long as you maintain an account or as otherwise necessary to provide you the Services. We will also retain your Personal Data as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.
Where permissible, we will also delete your Personal Data upon your request, after which we may not be able to continue to provide you with the Services. Information on how to make a deletion request can be found by logging into your MyAccount.
Security of your Personal Data
Fanytel uses standard security technologies and procedures to ensure the protection of your Personal Data against unauthorized access, use, disclosure or destruction.
Fanytel takes security measures, such as technical and organizational measures against unauthorized or unlawful access to your Personal Data and against accidental loss or destruction of, or damage to your Personal Data.
Any sensitive information, such as your credit card number are protected by encryption. The encrypted communication is established using Secure Sockets Layer (SSL) technology.
Indeed, SSL provides the secure exchange of data between two computers in order to ensure the confidentiality, integrity of exchanged information and authentication by recognition of the identity of the program, the person or company with which the Personal Data is exchanged.
Third-Party Sites and Privacy Practices
We verify new registrants’ phone numbers with a third party provider. By registering to Fanytel application, you agree and allow us to upload your phone number information to https://graph.accountkit.com as required by our provider for verification.
Changes to Policy
From time to time, we may revise this Policy. We reserve the right to update or modify this Policy, or any other of our policies or practices, at any time with or without notice. We will post the revised Policy on the Site, so that users can always be aware of what information we collect, how the information is used and under what circumstances such information may be disclosed. You agree to review the Policy periodically so that you are aware of any modifications. Your continued use of the Site indicates your assent to any changes and signifies your agreement to the terms of our Policy. If you do not agree with these terms, you should not use the Site, the apps, or any of the other Services.
